1. Who We Are — Legal Notices (Mentions Légales)

These Terms of Service (“Terms”) govern your use of the Strat·It mobile application (“App”) operated by Pierre Cheneau EI (“we”, “us”, “our”), a sole proprietorship registered in France.

In accordance with Article 6 of the French Law No. 2004-575 of June 21, 2004 (LCEN):

By creating an account or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the App.

2. Eligibility and Accounts

2.1 Age Requirement

You must be at least 13 years old to create an account. In countries where the digital age of consent is higher (15 in France, 16 in Germany), a parent or legal guardian must consent to account creation on behalf of the minor.

By creating an account for a person under the applicable age of consent, the parent or legal guardian agrees to these Terms on the minor’s behalf and accepts responsibility for the minor’s use of the App.

Players of any age may view strategies shared by their coach via a link or QR code without an account — no age restriction applies to viewing shared content.

2.2 Account Registration

When you create an account, you agree to:

• Provide accurate information (email address, display name).
• Keep your password secure and not share it with others.
• Notify us promptly if you suspect unauthorized access.
• Not create multiple accounts to circumvent tier limits.

2.3 Anonymous Mode

You may use the App without an account in anonymous mode, with limited features (3 strategies, 6 frames, no cloud sync). Anonymous usage does not require agreement to these Terms, but you agree to the acceptable use rules in Section 7.

3. What We Provide

3.1 The Service

Strat·It is a multi-sport strategy creation and animation tool. The App allows you to:

• Create, animate, and share game strategies for 12 sports.
• Collaborate with teams (paid tiers).
• Publish strategies to the community.
• Export strategies as video (MP4/GIF) or backup files.

3.2 Service Availability

We strive to keep the App available, but we do not guarantee uninterrupted access. The App may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will notify users of planned downtime when possible.

3.3 Offline Mode

The App works offline for local strategy creation and editing. Cloud features (sync, sharing, community, teams) require an internet connection.

4. Subscription Tiers

4.1 Free and Paid Tiers

The App offers the following tiers:

4.2 Changes to Tiers

We may modify tier limits or pricing with reasonable notice. If a change reduces your current tier’s capabilities, you will be notified in advance and given the opportunity to export your data.

4.3 Subscriptions (Future)

Paid subscriptions are not yet available. When introduced, they will be managed through the Apple App Store or Google Play Store. Subscription terms (pricing, renewal, cancellation) will be clearly disclosed before purchase and will follow the respective store’s policies.

4.4 Right of Withdrawal (EU Consumers)

Under EU Directive 2011/83/EU and French consumer law (Code de la consommation, Articles L221-18 et seq.), you have a 14-day right of withdrawal from any paid subscription, starting from the date of purchase. To exercise this right, contact us at [email protected] or use the cancellation mechanism provided by the Apple App Store or Google Play Store.

If you request immediate access to paid features before the withdrawal period expires, you acknowledge that you will lose your right of withdrawal once the digital content has been fully provided. You will be asked to give explicit consent and acknowledgement of this before any purchase is completed.

5. Your Content

5.1 Ownership

You own the strategies, templates, and content you create. We do not claim ownership of your work.

5.2 License You Grant Us

By using the App, you grant us a limited, worldwide, non-exclusive, royalty-free license to:

• Store and process your content to provide the service (cloud sync, sharing, backup).
• Display your content to you and to users you choose to share it with.
• Display community posts you publish to all App users.

This license exists only to operate the service. We do not use your strategies for advertising, sell your content, or share it with third parties beyond what is necessary to provide the service.

5.3 Community Posts

When you publish a strategy to the community, it becomes publicly visible to all App users. You retain ownership, but you grant all users a non-exclusive right to view your published content.

You can unpublish (soft-delete) a community post at any time. If you delete your account, your community posts will be anonymized (author shown as “Former Member”) rather than deleted, to preserve the community knowledge base.

5.4 Shared Strategies

When you share a strategy via a cloud link:

• Only people with the link can access it (zero-trust encryption).
• You can revoke the share at any time.
• You may set expiration dates and view limits (Pro+ tiers).
• Recipients may save a local copy if you allow copying.
• We cannot access your shared content — the encryption key is in the URL fragment and never reaches our servers.

6. Team Collaboration

6.1 Team Ownership

The user who creates a team is its owner. The owner can invite members, assign roles (coach or player), and manage team settings.

6.2 Team Data

Team strategies are encrypted with a shared team key that only team members can decrypt. When a member leaves or is removed, their access to team strategies ends.

6.3 Team Owner Account Deletion

If a team owner deletes their account:

• Teams with remaining active members are archived (members retain read access to existing team data).
• Teams with no remaining members are deleted.
• Ownership cannot currently be transferred; this feature is planned for a future update.

7. Acceptable Use

You agree not to use the App to:

• Harass, threaten, or abuse other users.
• Publish content that is illegal, defamatory, obscene, or hateful.
• Infringe on the intellectual property rights of others.
• Distribute spam, malware, or unauthorized commercial content.
• Attempt to circumvent tier limits, security measures, or access controls.
• Reverse-engineer, decompile, or extract source code from the App.
• Use automated tools (bots, scrapers) to access the service.
• Impersonate another person or misrepresent your identity.

We reserve the right to suspend or terminate accounts that violate these rules, with notice where practical.

8. Content Moderation

8.1 Community Content

Community posts are user-generated and not pre-moderated. We do not review content before publication.

8.2 Prohibited Content

Content that is illegal under EU or French law, including but not limited to hate speech, incitement to violence, harassment, child exploitation material, or content that infringes on the intellectual property of others, is prohibited and will be removed.

8.3 Reporting

Users can report community posts they believe violate these Terms. We will review reports within 7 business days and take appropriate action, which may include removing content, issuing a warning, or suspending accounts. You will be notified of the outcome.

8.4 Appeals

In accordance with the EU Digital Services Act, you may appeal a content moderation decision by contacting us at [email protected]. Appeals will be reviewed by a person (not automated) and you will receive a response within 30 days.

9. Data and Privacy

9.1 Privacy Policy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9.2 Data Export

You can export your strategies at any time using the backup feature in Settings > Data Management > Backup. Exports are provided in a structured, machine-readable format with optional encryption.

9.3 Account Deletion

You can delete your account at any time from Settings > Account > Delete Account. Deletion is permanent and removes all your data from our servers. See our Privacy Policy for full details.

9.4 Encryption

All strategy data is encrypted with AES-256-GCM. Encryption keys are stored on your device, not on our servers. We cannot access your encrypted content. For full details, see Section 5 of our Privacy Policy.

10. Intellectual Property

10.1 Our Property

The App, its design, code, branding, and all associated intellectual property belong to Pierre Cheneau EI. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.

10.2 Restrictions

You may not copy, modify, distribute, sell, or lease any part of the App or its code, except as expressly permitted by applicable open-source licenses for third-party components.

10.3 Feedback

If you provide feedback or suggestions about the App, you grant us a non-exclusive, royalty-free license to use them to improve the App, to the extent permitted by applicable law. This does not affect your moral rights under French law. You are not obligated to provide feedback.

11. Third-Party Services

The App uses third-party services to operate. By using the App, you acknowledge that your data may be processed by these services in accordance with their own terms:

• Supabase — authentication, database, cloud storage (supabase.com/legal)
• Firebase / Google — analytics, crash reporting, performance monitoring (firebase.google.com/terms)
• Have I Been Pwned — password breach checking (haveibeenpwned.com)

We have Data Processing Agreements with all processors as required by GDPR.

12. Limitation of Liability

12.1 Service Provided “As Is”

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

12.2 Digital Content Conformity (French Law)

Under French consumer law (Code de la consommation) and EU Directive 2019/770, digital content must conform to its description and be fit for its intended purpose. If the App does not conform to these Terms or does not function as described, you may request that we bring it into conformity. This legal conformity guarantee applies for 2 years from the date of supply. To report a conformity issue, contact us at [email protected].

12.3 Limitation

To the maximum extent permitted by applicable law, Pierre Cheneau EI shall not be liable for:

• Loss of data due to device failure, software bugs, or circumstances beyond our control.
• Interruption of service or inability to access cloud features.
• Actions taken by other users (e.g., misuse of shared strategies).
• Indirect, incidental, special, or consequential damages.

Nothing in these Terms excludes our liability for gross negligence, fraud, or violations of your statutory consumer rights.

12.4 EU Consumer Rights

Nothing in these Terms limits your statutory rights as a consumer under EU law, including the right to statutory warranties for digital content under Directive (EU) 2019/770.

13. Force Majeure

Neither party is liable for failure to perform obligations due to causes beyond reasonable control, including but not limited to: server outages, cyberattacks, natural disasters, pandemics, or government actions. If such an event prevents us from providing the service for more than 90 consecutive days, you may terminate your account and we will make reasonable efforts to allow you to export your data.

14. Beta and Early Access

The App may include beta or early-access features. These features are provided for testing purposes and may be unstable, incomplete, or subject to change without notice. We do not guarantee data persistence or availability for beta features. Beta features are clearly marked within the App.

15. Termination

15.1 By You

You may stop using the App at any time. You may delete your account from Settings > Account > Delete Account.

15.2 By Us

We may suspend or terminate your account if you violate these Terms, with notice where practical. In case of serious violations (e.g., illegal content, security threats), we may act immediately without notice.

15.3 Effect of Termination

Upon termination, your license to use the App ends. We recommend exporting your data before deleting your account, as deletion is permanent.

16. Dispute Resolution

16.1 For EU Users

Disputes are governed by the laws of France and the consumer protection laws of your country of residence. You may bring claims in your local courts. Mandatory arbitration does not apply to consumers in the European Union.

You may also file a complaint with your national consumer protection authority or the European Commission’s Online Dispute Resolution platform (ec.europa.eu/odr).

16.2 For Non-EU Users

Disputes are governed by the laws of France. You agree to submit to the exclusive jurisdiction of the courts of France for any disputes arising from these Terms.

16.3 Informal Resolution

Before initiating formal proceedings, we encourage you to contact us at [email protected] to attempt to resolve the dispute informally. We will respond within 30 days.

17. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by updating the “Last updated” date at the top. For significant changes, we will notify you through the App at least 30 days before they take effect.

If you continue to use the App after changes take effect, you accept the updated Terms.

18. General

• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Pierre Cheneau EI regarding the App.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
• No Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: We may assign our rights under these Terms to a successor entity, with prior notice to you. You may not assign yours without our consent.
